Under federal law sexual harassment in the workplace is unlawful. Sexual harassment can cover a whole range of behaviors. It may include unwanted sexual advances, requests for sexual behavior or other verbal and physical conduct of a sexual nature. Quid Pro Quo is a type of sexual harassment where a supervisor or authority figure in the workplace offers or hints that they will provide a promotion or benefits in exchange for sexual favors. In Latin, quid pro quo means “this for that.” This form of sexual harassment can also occur where a supervisor threatens firing, demotion or another form of punishment if the person does not agree to sexual demands. This type of harassment also occurs in the hiring process. Quid Pro Quo harassment is unlawful and should not be tolerated under any circumstances.
When sexual harassment is so severe and pervasive in the workplace it may create an environment that is impossible to work in and even damaging to a person’s health. This is recognized as a hostile environment under the law. This environment may be created by a supervisor, co-worker or by multiple actors.
